10.16.3007    ELIGIBLE STUDENTS UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT

(1) To be eligible for special education and related services under the Individuals with Disabilities Education Act (IDEA), a student must meet the criteria for one or more of the disability categories listed in ARM 10.16.3010 through 10.16.3022.

(2) The disability must adversely affect the student's educational performance such that the student needs special education as defined in 34 CFR 300.39.
