38.5.1409    TERMINATION NOTICE FOR NONPAYMENT-WHEN PROHIBITED

(1) A notice of termination of service may not be issued for nonpayment of a delinquent account if the entire amount is disputed by the customer and the customer is currently negotiating the dispute with the utility or has filed a complaint with the commission. A utility may, however, issue a notice of termination of service with respect to that portion of any delinquent account which is not disputed by the customer.
